CalWORKs cases with no eligible adult in the Assistance Unit AU to be transitioned from a periodic reporting system to an annual reporting system Purpose This section is being revised to update the Income Reporting Threshold IRT threetier system to two The Tier 1 IRT will remain the same and the existing Tier 2 will be replaced with the existing Tier 3 130 of the Federal Poverty Level FPL The change to the IRT tier system is effective June 1 2020 Policy Annual ReportingChild Only ARCO cases are required to report changes once per year during the annual redetermination or mandatory midyear changes within ten days There are no SAR 7 or other periodic reporting requirements for ARCO AUs The annual redetermination will occur in the last month of the ARCO benefit period month 12 Any mandatory change that is reported in month 12 will be verified and evaluated as part of the annual redetermination Information that becomes known to the County or is provided through a third party may not require midperiod action if the information was not required to be reported per ARCO rules ARCO Cases If there is no aided adult in the AU the CalWORKs case is generally an ARCO case The following are the most common ARCO case scenarios where all adults in the AU isare Timed out Safety Net case In a fleeing felon status or found by a court to be in violation of probation or parole Not qualified for CalWORKs due to immigration status Not cooperating with Social Security Number SSN requirements Receiving Supplemental Security Income SSI A NonNeedy Caretaker Relative Sanctioned due to refusal to assign childspousal support rights Convicted of an Intentional Program Violation IPV prior to July 1998 A striker and is not eligible to CalWORKs Sponsored noncitizen whose needs are being met by hisher sponsor Any AU in which an adult is aided is not considered to be an ARCO case and will continue to be subject to periodic reporting requirements The following are nonARCO case scenarios Cases where the adults isare not aided due to Employment Services ES sanction Cases that are subject to a penalty unless there is no adult in the AU Twoparent households where one parent remains aided and included in the AU Any case in which optional members have opted to be included in the AU and receive CalWORKs County of San Diego Health and Human Services Agency HHSACalWORKs Program Guide Number Page Annual Reporting AR 44260A 2of 5 ES Sanction and Parole Violation AU of 1 Only the child is receiving CalWORKs Scenario Dad is currently ES sanctioned and then is later found by a court of law to be in violation of his parole This is now an ARCO case because of the violation of parole Outcome Periodic reports are no longer required Scenario Outcome Refusal to Assign Support Rights Single Dad applying for CalWORKs for himself and his two minor children Dad signs the Notice and Agreement for Child Spousal and Medical Support CW 21 and checks the box for I refuse to assign childspousal support rights cash aid He does not claim Good Cause All other eligibility criteria are met and the case is ready to be approved A Child Support sanction is imposed against Dad due to his refusal to assign support rights The case is approved for an AU of two Only the children are eligible to receive CalWORKs This is an ARCO case Periodic reports are not required Scenario Outcome Refusal to Cooperate with Child Support Single Mom and her minor child AU of 2 Both are receiving CalWORKs The Family Resource Center is contacted by the Department of Child Support Services DCSS and a Referral to Local Child Support Agency CW 371 is provided Mom has failed to respond to several requests for information and did not appear for any appointments scheduled by DCSS There is no good cause or other exemption A Child Support penalty is imposed against mom to reduce the CalWORKs grant by 25 and also place a restriction on her MediCal MC benefits This is not an ARCO case Periodic reports are still required Mandatory Reporting Timely and adequate notice is required if a mandatory report results in a decrease or discontinuance of CalWORKs If a change is reported that does not require midyear action issue a No Change Notice of Action NOA and note the information as a Held Change for followup at the next annual redetermination The following changes are required to be reported by all ARCO AUs within ten calendar days Address changes Fleeing felon status Court findings of probation or parole violations Changes in household composition When income exceeds the Income Reporting Threshold IRT County of San Diego Health and Human Services Agency HHSACalWORKs Program Guide Number Page Annual Reporting AR 44260A 3of 5 Voluntary Reporting Changes in income and circumstances may be voluntarily reported at any time Midyear action for voluntarily reported changes will only be taken when Verification provided results in an increase in CalWORKs benefits The customer is requesting to discontinue CalWORKs for an optional member of the AU The effective date of an increase in benefits will be based on when the change was voluntarily reported not when the change occurred The following shows how the type of change determines when to increase CalWORKs benefits If a decrease in income is reported then CalWORKs will increase effective the 1st of the month in which the change occurs or is reported whichever is later If a new member of the household is reported then CalWORKs will increase effective the 1st of the month after the change is reported Allow ten days for the customer to provide verification and will be processed as follows If adequate verification is received by the tenday due date then actions will be taken to increase benefits If adequate verification is not received then a No Change Notice will be sent If adequate verification is received after the tenday due date then the date the verification is received will be considered the date of the voluntary report and the received date will be used to determine when to increase benefits CountyInitiated Actions ARCO rules require the County to take midperiod action on certain changes in eligibility even if the action will result in a decrease or discontinuance of aid for the AU The following changes require midperiod action A sanction or financial penalty is imposed on an individual in the AU A financial penalty is removed from an AU that complies with CalWORKs program requirements A child in the AU reaches the CalWORKs age limit A child in the AU is placed in Foster Care Aid is authorized for an individual who is currently aided in another AU State Hearing decision resulting in mandatory changes midperiod An AU becomes a Family Reunification case An AU member is no longer a California resident Information from a redetermination is acted upon midperiod An erroneous payment caused by incorrect or incomplete customer reporting or incorrect action or lack of action by the county is corrected An individual in the AU is deceased Effective January 1 2016 a deceased child will continue to be included as a member of the AU in the month in which his or her death occurred and the following month An AU is transferred to a Tribal TANF program Costofliving adjustments COLA for Minimum Basic Standards of Adequate Care MBSAC including income inkind Maximum Aid Payment MAP and first of the month and is expected to remain for that full calendar month or longer A ninemonth real property exemption expires A nonminor dependent NMD is transferred into their own AU Recoupment for an overpayment begins via grant reduction A Trafficking and Crime Victims Assistance Program TCVAP customer is no longer eligible to statefunded services or becomes eligible to federally funded programs Income Reporting Threshold IRT Refer to CPG 44270G for complete IRT information Transitioning ARCO Cases Under certain circumstances a case may transition between ARCO and SAR or vice versa The following are situations that may result in a case transitioning between ARCO and SAR When certain sanctions are imposed or lifted When adults become timedout or added back to the AU due to child support reimbursement or overpayment recoupment When an adult moves into the home and is added to the AU The following rules apply when a case transitions between ARCO and SAR The case will continue to have the same reporting cycle and redetermination date A SAR 7 cannot be due in the same month in which an adult is being added back to the AU The next SAR 7 will be due in the SAR period after the adult is added to the AU unless the annual redetermination is due A SAR 7 will not be required for any month in which the AU met ARCO criteria For cases where a SAR 7 is due in one month but the case transitions to ARCO in the following month if the customer fails to submit a complete SAR 7 the case will not be discontinued and the grant will remain unchanged When a case transitions from SAR to ARCO the case will become an ARCO case effective the 1st of the month after the adult is removed from the AU Scenario Outcome NonNeedy Caretaker Relative Requests CalWORKs An AU of 2 consists of a nonneedy caretaker relative and 2 minor children On June 2nd the nonneedy caretaker relative reports she lost her job and is now requesting CalWORKs for herself After she has met all CalWORKs eligibility requirements the nonneedy caretaker will be added to the AU effective July 1st The SAR cycle and redetermination date remain unchanged The worker will issue the following forms CW 2212 to inform the customer of the change to SAR reporting responsibilities and SAR 2 if there is a change in IRT County of San Diego Health and Human Services Agency HHSACalWORKs Program Guide Number Page Child Support reimbursement process in May a lumpsum amount is applied to the case and used to repay four months of aid Effective June 1st Mom is automatically added back to the AU The SAR cycle and redetermination date remain unchanged The worker will issue the following forms CW 2212 to inform the customer of the change to SAR reporting responsibilities and SAR 2 if there is a change in IRT If there is no additional child support reimbursement Mom will be discontinued from the AU effective September 30th and the CalWORKs case will transition from SAR to ARCO effective October 1st The worker will issue the following forms CW 2211 to inform the customer of the change to ARCO reporting responsibilities and AR 2 or AR 2 SAR if there is a change in IRT Procedure CalWORKs Processing Guides
