991057 1 of 3 Revision Date April 1 2021 BackgroundThis section provides information regarding the suspension reinstatement and termination of Cash Assistance Program for Immigrants CAPI payments and reapplication for these benefits This section is updated for the sunset review no program rules have changed PurposeTo provide the policy for suspension reinstatement and termination of and reapplication for CAPI benefits Policy1 Suspension of Benefits Suspension is an interruption of CAPI benefits due to a recipients failure to satisfy one or more CAPI eligibility requirements The suspension of benefits is always effective the first day of a month in which an individual no longer meets all eligibility requirements Enter a Case Comment regarding the period of suspense which is 12 consecutive months after the effective date of the suspension Overpayment collection procedures may apply see 99109 Send a Notice of Action NOA NA 692 and check the Suspension option as well as selecting the appropriate reason from the list If the reason is noncooperation list the specifics in the comments field 2 Reasons for Suspension Suspend benefits when the recipient Has income in the budget month which exceeds the appropriate payment standard in the payment month Fails to provide proof of application for Supplemental Security IncomeState Supplemental Payment SSISSP benefits or fails to take all necessary steps to obtain SSISSP Becomes eligible for SSISSP Fails to cooperate or provide requested information within 30 days of the Human Services Specialists HSS written request for information or documentation Is a resident of a public institution for an entire calendar month Is no longer a California resident Has resources which exceed the allowable limit Is fleeing to avoid prosecution for a felony or is violating a condition of probation or parole Fails to file for all other possible benefits 3 Reinstatement of Benefits after Suspension An individual has 12 consecutive months after the effective date of the suspension to regain eligibility and have benefits reinstated without having to file a new application The individual must submit any required verifications except evidence of age disability or blindness to reestablish eligibility If the annual redetermination is due or was due during the suspension the redetermination must also be completed Reapplication for Benefits Number Page 991057 2 of 3 Reinstate payments to such recipients effective the first day they meet all eligibility requirements Do not wait until the following month In these scenarios make a partial month CAPI payment to the recipient Refer to the proration chart in Desk Aid 991057A CAPI Proration Chart The following is provided as an example of a possible reinstatement situation Example The CAPI HSS requests a CAPI recipient to apply for SSI in January 2021 The recipient does not comply with the requirement to apply for SSI within 30 days of the HSSs request The HSS suspends the CAPI case effective the first of March 2021 The recipient returns on March 3 with proof that they have applied for SSI on that date The HSS must reinstate CAPI effective March 3 The following are provided as examples of possible retroactive reinstatement situations Example 1 A recipient exceeds the resource limit for the month of September 2020 accordingly CAPI benefits are suspended In February 2021 the recipient provides evidence that since December 2020 the amount of his resources has remained under the resource limit When the HSS finds that a suspended recipient has regained eligibility CAPI payments must begin immediately In this case reinstate benefits retroactively to December 2020 Example 2 The HSS sent the recipient the annual redetermination paperwork with an interview appointment on March 3 2020 The appointment was on April 3 2020 On April 7 the HSS found the recipient to be ineligible for benefits due to noncooperation with the redetermination process As a result of the recipients failure to attend the redetermination interview the HSS issued a suspension notice effective May 1 2020 On July 15 2020 the recipient provided the HSS with all the information requested and attended a redetermination interview On July 25 the HSS finds the recipient qualified to begin receiving benefits again Retroactively reinstate CAPI benefits as of May 1 When suspended CAPI benefits are reinstated send the NOA NA 692 with Reinstatement of Suspended Benefits checked and fill in the date of reinstatement If the new benefit amount is different from the previous benefit amount also check Change in Benefits and enter the new payment amount information Select the appropriate reason from the list 4 Termination of Benefits Termination means that a former CAPI recipients benefits have ended and may not be reinstated Termination requires an individual to file a new application to receive CAPI benefits Terminate a CAPI case when the recipient Has had CAPI benefits suspended for 12 consecutive months Becomes a United States US citizen unless they request Conditional CAPI after Naturalization Dies Is no longer blind or disabled if under age 65 Asks to voluntarily terminate hisher CAPI benefits Send NOA 692 and check the Termination box Enter the date of termination and check the appropriate box from the list County of San Diego Health and Human the recipient to file a new application to reestablish eligibility following termination The new application must use a new application number and date Procedure Follow the actions in the policies above for suspending reinstating terminating or when the individual reapplies for CAPI benefits Program ImpactsAutomation NA 692 Until the NA 692 is updated in CalWIN use the NA 692 in the Eligibility Forms Library EFL to notify the recipient of suspension termination reinstatement or change in grant A copy of the completed NOA from the EFL must be imaged Suspension Set a Case Alert for 12 months from the suspension to send the NA 692 again to notify the recipient of termination if the case has not been reinstated Termination Send NA 692 to notify the recipient of the termination and that they must reapply if they want to be evaluated for CAPI eligibility Reinstatement Until the reinstatement of CAPI aid is automated in CalWIN use the proration chart to determine the proper amount of aid for the first month from the date that aid is reinstated Issue aid via NonSystem Determined Issuance NSDI procedures Send NA 692 to notify the recipient of the reinstatement References MPP 49060 ACLs
