Revision Date August 1 2019 A Background Eligibility requirements for CAPI are the same as for SSISSP except for citizennoncitizen status Purpose This section is updated for the sunset review No Program rules have changed B Policy An individual is If heshe is eligible for CAPI A noncitizen and meets the appropriate immigration status provisions described in 991012 Age 65 or over blind or disabled of any age as defined for SSISSP purposes Ineligible for SSISSP solely due to hisher immigration status but meets all other current SSISSP eligibility except as modified by CAPI regulations A current resident of California Under the income and resource limits Ineligible for CAPI Is a resident of a public institution for example jail prison VA hospital for an entire month Flees to avoid prosecution custody or confinement after conviction for a felony under the laws of the place from which the person flees Violates a condition of probation or parole imposed under federal or state law Is outside of the US for an entire calendar month Fails to file for all other available benefits 1 Ineligible for SSISSP To be eligible for CAPI an individual must be ineligible for SSISSP solely due to hisher immigration status see 99107 regarding requirements to apply for SSISSP This ineligibility must be verified by one of the following Formal or informal denial letter or verbal confirmation from SSA issued after August 1 1998 and within six months of the CAPI application that states the person is ineligible for SSISSP due to immigration status Screen print from MEDS indicating the N13 alien denial status Verification that the applicant is not a Qualified Alien 2 CAPI Eligibility Pending SSI Decision An otherwise eligible individual may qualify for CAPI if verification is obtained that a current SSISSP application is pending a final determination This would also include a pending appeal if the issue under appeal is related to the applicants disability or immigration status If an individuals SSI denial is based on a finding of not disabled heshe must appeal that decision The SSI Advocate can obtain information from SSI on a case with a signed release of information from the individual Use
